Work Permit

A Labuan Work Permit, also known as an Expatriate Visa Category 1, is a work permit issued through Labuan Immigration allowing eligible foreigners to live and work in Malaysia under a Labuan company.

The Labuan Work Permit is generally valid for two years.

Yes. The Labuan Work Permit is renewable every two years subject to compliance with tax laws such as payment of personal income tax and approval by LFSA and Immigration, Labuan branch.

Applicants must have a valid passport, meet minimum salary requirements, possess a university degree, and maintain a personal bank account for salary payment purposes.

The minimum salary requirement is RM10,000 per month.

Applicants are generally expected to hold a university degree. In certain cases, applicants without a degree may still qualify with additional supporting documents and professional references.

The process generally involves 2 tiers — Tier 1: document collection and submission to LFSA, followed by Tier 2: submission to Labuan Immigration for approval and endorsement.

Processing timelines vary depending on document readiness and authority review timelines. LFSA processing may take between 7 to 21 working days depending on track selection, followed by Immigration processing.

Required documents generally include passport or NRIC copies, proof of address, and additional corporate documents where applicable.

After incorporation, AAE will provide incorporation documents and may assist with bank account opening and work permit applications.

Yes. AAE may assist eligible clients with Labuan work permit applications following incorporation.

Compliance & Tax

Two main annual compliance: Pay annual fee to LFSA for the company, and file Annual Return of the company. Other obligations include payment of AAE's annual fees, audit of management accounts, lodgment of audit report with LFSA and LHDN.

Companies are generally expected to appoint an auditor and determine their financial year end exactly at the one year anniversary date. Corporate tax submission to be made 6 months after the end of the financial year.

Appointment of a tax agent may be required when the tax submission is due, i.e., 6 months after the end of the financial year.

The employer must be a Labuan company with a physical office, payroll arrangements, human resource support, and a corporate bank account.
